The short answer is no. In Barcelona, as in the rest of Spain, consuming cannabis on the street or in any public space is prohibited and can lead to a financial penalty. This article explains, cautiously, what the current rules say and why the private space of a cannabis association is governed by different ones.

What the law says about public consumption

The reference framework is Organic Law 4/2015 of 30 March on the protection of public safety. Its article 36.16 classifies the consumption or possession of toxic drugs, narcotics or psychotropic substances in public places, roads or premises, as well as on public transport, as a serious infraction. The penalty for serious infractions ranges from 601 to 30,000 euros, and the exact amount depends on the circumstances of each case.

This means that lighting a cannabis cigarette in a square, on a pavement, in a park or on public transport in Barcelona can result in an administrative fine. Personal consumption is not a criminal offence, but it is an infraction that the administration can penalise.

Barcelona: public space and local ordinances

In addition to the national rule, Barcelona has municipal coexistence ordinances that reinforce the ban on consuming substances in public space. The combination of both leaves little room: the public street is not a place authorised for cannabis consumption, nor is the interior of premises open to the general public.

The private space of a cannabis association

This is the key difference. A cannabis association is neither a public venue nor a point of sale. It is a private, non-profit entity whose access is reserved exclusively to its members. Within that private space, and only within it, the association carries out its activity in accordance with its statutes and the conditions it sets.

Several consequences follow from this framework:

  • It is not a point of sale to the public. The sale of cannabis is prohibited, and an association does not sell to passers-by.
  • Access is for members only. It is not a walk-in venue.
  • Consumption takes place inside the private space. What happens inside the association does not authorise consumption outside: on the street the general prohibition still applies.

It operates as a private association with access reserved for members, open from 12:00 to 23:00 every day of the week. All activity takes place inside the association’s space; cannabis is never consumed or taken out onto the public street.
